Part 1: Amanda Lyman v. Allen William Bell
From time to time, a case cannot be resolved through settlement and must be decided by a jury. That is where we are with Amanda Lyman v. Allen William Bell, a pedestrian-versus-vehicle case arising from a crash on Perdido Key Drive near River Road.
According to our client’s allegations, Ms. Lyman was in a crosswalk when she was struck by a vehicle driven by Mr. Bell. We allege the crash caused a brain injury as well as lower-back disc herniations and extrusions. The defense disputes this claim.
Jury selection is currently scheduled for Monday, October 12, before Judge Pitre. However, another older case is ahead of ours on the trial calendar, so we may not know until later this week whether the trial will proceed as scheduled.

The property-damage threshold has increased from $500 to $2,000, but that doesn’t mean you should wait to call law enforcement after a crash.
Without an official crash report, important evidence about what happened and who was at fault may be harder to establish. That can become especially important in Florida, where the law now limits recovery when someone is found more than 50% at fault.
If you’re involved in a crash and there’s any damage or potential for injury, call law enforcement and have the crash documented. You may not know the true extent of the damage at the scene.

CASE UPDATE:
Today, we took the deposition of the in-hospital pathologist involved in Mr. Bryan’s case. He testified that he was tasked with determining whether the tissue removed was the spleen or the liver, did his job, notified the hospital, and that the hospital ultimately reported it to the medical examiner.
Dr. Shaknovsky was filling out reports indicating that this was a death from a splenic aneurysm. That’s the contradiction in the case that we have and one of the issues that the jury will have to resolve.
